Part 2.3 - Approval of Regulations
2.3.1. Internal and external presentation of the draft regulations
Once the draft regulations are ready, it is recommended that an internal presentation be made, including members of the technical group, as well as all the areas that will give their opinion for the approval of the regulations, particularly those responsible for their application.
It is also recommended to carry out an external presentation, which could include the publication of the new regulations on the institutional web page to receive comments for at least twenty days. A faceto- face or virtual presentation could also be carried out to receive comments from key actors linked to the construction sector, as well as neighbors and society in general, or any other modality that allows for consultation with actors linked to the subject and citizens. Subsequently, a matrix of comments can be made, responding to each comment or contribution received, evaluating or not its incorporation to the final text of the normative project.
2.3.2. Technical-legal support report
Once the final version of the draft regulations is ready, a technical report should be prepared to support it. Annex I provides a list of suggested contents that could support the drafting of the technical legal report.
If necessary, a presentation of the proposed regulation should be made to the municipal council or to a commission of councilors or aldermen linked to land use planning or urban development, before the regulation is submitted to the full council for approval.
Based on the regulatory framework of each country, a determination has to be made whether the standard requires ratification by a higher level municipality such as a metropolitan or provincial municipality or by the corresponding state.
